Exits go wrong in two places: the notice period (how long, whether it can be bought out, what happens if the employee leaves early) and the full and final settlement (what is in it, when it is paid, and what the employer may deduct). This skill reads the position from the person's documents, itemises what they should expect, and drafts the escalation if the money is late. It is preparation, not legal advice.
What This Skill Produces
- The notice position: contractual period, whether buy-out or adjustment against leave is allowed, and what early exit costs
- An itemised full and final settlement estimate with each component, its basis and what can lawfully be deducted
- The timeline the person can reasonably expect and the record they should keep
- A reconciliation checklist for the F&F statement the employer sends
- A polite but firm escalation email, escalating in two steps (HR, then the authority), if payment is late
Required Inputs
Ask for (if not already provided), else infer and label as an assumption:
- Notice period in the appointment letter or HR policy, and the company's standing orders if any
- Resignation date, last working day asked for, and whether the manager has accepted
- Monthly gross and basic, accrued and unused leave balance, any pending bonus or variable pay
- Years of service (gratuity eligibility) and whether a bond, training agreement or notice buy-out clause exists
- Company assets, loans, advances or relocation claw-backs outstanding
- Whether the person is a workman under the Industrial Disputes Act or a managerial employee (affects remedies)
Framework: Notice and Settlement
- Notice period. The appointment letter governs, within the standing orders and any state Shops and Establishments Act rules. Typical periods run from 30 to 90 days. An employer cannot usually impose a longer period than the contract. A clause requiring payment in lieu allows buy-out at the stated rate, often basic or gross for the unserved days; verify which.
- Leaving early. If the contract allows pay in lieu, the employer may recover it from the F&F. Without such a clause, recovery is contestable. Leave balance can be adjusted against notice only if policy permits.
- Bonds. A training bond is enforceable only to the extent of a reasonable, proven cost. Flag it rather than assume it is binding.
- What the F&F must contain. Salary up to the last working day; encashment of earned leave as per policy and the state Act; pro rata statutory bonus if eligible; gratuity if five years are served (or the 4 years 240 days position); pending reimbursements; any notice pay owed to the employee. Deductions: notice recovery if the clause exists, unreturned assets, outstanding loans or advances, tax on the taxable components.
- Timelines. The Payment of Wages Act requires final wages within a short period after termination for covered employees (verify the exact days); many companies pay F&F within 30 to 45 days by policy. Gratuity is due within 30 days of it becoming payable, with interest thereafter. Relieving letter and experience letter should accompany or follow.
- Escalation. First a written reminder to HR with the itemised claim and the due date; then a formal notice; then the labour commissioner or the controlling authority under the Payment of Gratuity Act for the gratuity part, or a civil claim for the rest. Keep the resignation acceptance, the F&F statement, payslips and the leave balance screenshot.
Output Format
Exit settlement for [name or "you"]
Notice: contract says [n] days; you [served / propose to serve] [n] days; [buy-out allowed at (basis) / not provided for]; early-exit cost about [amount, illustrative].
Full and final estimate (illustrative; reconcile with the employer's statement):
| Component | Basis | Amount |
|---|---|---|
| Salary to last working day | [days] x [daily rate] | [amount] |
| Leave encashment | [days] x [rate per policy] | [amount] |
| Statutory or contractual bonus | [pro rata, if eligible] | [amount] |
| Gratuity | [eligible / not yet / arguable] | [amount] |
| Reimbursements | [pending claims] | [amount] |
| Less: notice recovery | [unserved days x rate, if clause] | ([amount]) |
| Less: assets, advances, loans | [list] | ([amount]) |
| Less: tax on taxable items | [TDS] | ([amount]) |
| Net payable | [amount] |
When: [policy says (n) days; statutory floor for your category is (verify)]; gratuity within 30 days of leaving.
Reconcile the employer's F&F statement:
- Leave balance matches your last payslip or portal screenshot
- Notice recovery uses the contract's rate, not gross if the clause says basic
- Gratuity included if eligible and computed on basic plus DA
- No deduction for a bond without proven cost
- Relieving and experience letters issued
Escalation email (step 1, to HR):
Subject: Full and final settlement pending, last working day [date]
Dear [name],
My last working day was [date], and my resignation was accepted on [date]. As of today the full and final settlement has not been received. Per the policy, it was due by [date]. My itemised expectation is attached: [components]. Please confirm the payment date and share the F&F statement so I can reconcile it. If I do not hear back by [date, seven days], I will take this up with [the labour authority / the controlling authority under the Payment of Gratuity Act].
Regards, [name], [employee ID]
Prepared from the documents and figures given. Confirm with the appointment letter, the state Shops and Establishments rules and, for a disputed amount, a labour lawyer or the labour commissioner.
Quality Checks
- The notice position quotes the contract and says whether buy-out or leave adjustment is actually provided for
- Every F&F line has a stated basis and is labelled illustrative
- Deductions are limited to what the contract or law allows and the bond is flagged as contestable
- Timelines distinguish company policy from the statutory floor and mark the floor for verification
- The escalation email is polite, dated, itemised and sets a deadline; the preparation-not-advice line is present
Anti-Patterns
- Assuming 90 days because it is common. Read the letter.
- Accepting a notice recovery on gross when the clause says basic.
- Treating a training bond as automatically enforceable.
- Omitting gratuity for someone past five years, or the 240-day position for someone just under.
- Writing an angry escalation. Itemised and dated beats angry.
Example Trigger Phrases
- "My notice period is 60 days but I have a new offer in 30. Can I buy out the rest and what will it cost?"
- "F&F kab milega aur usme kya kya hona chahiye? Last working day 15 tarikh tha."
- "It has been 50 days since I left and no settlement. Draft an email to HR."
- "Check this F&F statement: they deducted 45 days of notice on gross and skipped leave encashment."
